I can't even call the hearing held on October 19, 2010 a showdown. It was just a sham.
Let's do a little review. Claudine is a battered mother who lost custody of her only daughter in an ex parte hearing in 2004. (Ex parte means the mother wasn't even represented at the hearing.) Since then, she has had very little visitation. The hearing in January 2010 (see post above) was supposed to fix that. And finally, Claudine was awarded two hours of unsupervised visitation on Sunday and telephone contact twice a week. We figured it was a start.
Well, this was not to be. And not because of anything Claudine did.
As Claudine testified, visitation went well. She taught her now teenage daughter to drive. They shopped. They went to Barnes and Noble. They talked about girl stuff. Boy stuff. Just like any other mother and daughter. In fact, Claudine was able to enjoy her first mother's day with her daughter in ten years. There were no negative interactions. In fact, it looked like some serious healing was going on.
And in that lays the problem. You see, abusers and their enablers don't like healing. They find that supremely threatening to their power and control. So of course, the process must be stopped lest their domination of the child and the overall "situation" be compromised.
So in May 2010, all visitation stopped at Dad HAL RICHARDSON's personal discretion--which he admitted during his own testimony. He made the unilateral decision that he would no longer take his daughter to the law enforcement center for visitation (presumably at her "request"--but more on that later.) He made sure that during the times of designated phone contact, the phone was never answered as it was set on fax. (67 Direct Contempt's Dad admitted under oath that the phone does go to fax mode when not answered--though he denied "inhibiting" phone access, which is not surprising. But then, how did Mom know to testify that the phone was set on fax when she called? Oh those little details....) But of course, Dad didn't exactly encourage or welcome contact either--that much was evident. In fact, it was pretty clear to me that he was extremely negative about Claudine, and doing his best to crush any contact between her and her daughter.
But like many abusers, he projected his own motives onto the child, now a teenager. SHE was the one who was "uncomfortable." She was the one who was "afraid." Afraid of what? Physical abuse, sexual violence? No, there was no evidence of that beyond vague innuendos about "fighting" that allegedly occurred in the distant past (These innuendos weren't even brought up in January. Must be a new game plan.)
Apparently we are supposed to believe that this teenage girl is "afraid" because Mom allegedly doesn't "follow the rules." What rules? Apparently the court's rules regarding discussion of this case.
All this was echoed by Guardian ad Litem JILL DYKES. And once again, just as in January, Ms. Dykes didn't even feign professional neutrality in this case, as she literally sat at Daddy's elbow the whole time.
Are you kidding me? The typical teenager would blow off a parent's attempt to discuss court matters--ASSUMING any such discussion took place, which Claudine denies. They certainly wouldn't be "afraid" of such a discussion. Annoyed perhaps. But not "afraid" or traumatized. This is just classic projection. That this teenager is such a hothouse flower that she is somehow irreparably injured by any possible or potential references to her parents' legal issues, which I'm sure she already knows all about anyway. Nonsense.
I would humbly suggest that it is Hall Richardson and his enablers who are "afraid" of any possible open or frank discussion of this case. Or any contact between this mother and daughter. And their little "feelings" shouldn't play any part of this.
Under Kansas law, visitation isn't shut off because somebody is "uncomfortable" for vague and specious reasons. If that were the case, then controlling and manipulative parents would be cutting off access for whatever reason they dreamed up that day.
Unfortunately, given the dynamics of domestic violence, children who are in the control of abusers often find it necessary to parrot what the abusers want for their own survival. Which makes if very difficult for this child to speak up and articulate what she wants--except in private to her own mother.
And frankly, this ordeal shows a complete double standard. Were this a custodial mother blocking visitation for such vague and specious reasons, she would no doubt be labeled as an "alienator" with "parental alienation syndrome" (PAS). And the situation would be addressed immediately--either visitation would be enforced by the courts or the mother would lose custody all together. But I digress.
So no visitation from May to the present. But this actually was a minor issue as far as the court was concerned.
No, once again our major concern was Claudine's political activity. The players in Shawnee County are very upset with how well known this case has become (my last blog posting on this case had readers as far away as Australia.) And they are blaming Claudine for all of it, even though when pushed, Judge DAVID DEBENHEIM fiercely denied that he was trying to "stomp" on Claudine's first amendment rights. (Huh. Could have fooled me.)
But even in cases where OTHER bloggers like Nancy Carroll at Rights for Mothers had discussed this case (http://rightsformothers.com/), Claudine was blamed. In fact, the opposing attorney submitted into evidence printouts from NANCY's blog to show that Claudine was out of compliance with their gag order. Message to the Hoffmans: Nancy is not Claudine. I'm not Claudine either, for that matter. And you can't shut us up.
And honestly, did the Hoffmans really have to embarrass their employee like that? They trotted out a young and painfully ignorant employee of theirs to "testify" about Claudine's "alleged" facebook and twitter activities. This fresh-faced young woman--no more than a high school graduate with a few "computer" classes--earnestly told us that every posting and link on somebody's facebook page had to personally "approved" and/or "posted" by that person. Yes, dear friends. She did say that. And meant it too, so far as I can tell. I won't give her name, though it's in my notes. I refuse to further humilate her. But honestly, your great aunt Rose probably knows more about facebook than this girl.
So the significance of this was what? There are supposedly "references" to her case on Claudine's facebook page! Oh the horror! And you know what? This blog may very well end up with a link on Claudine's facebook page, too--through an automatic feed mechanism. It will go straight to facebook--even when Claudine is sleeping or brushing her teeth. Or sitting in court. Because you know what? Claudine is a well networked activist with probably hundreds of facebook friends working on issues related to child abuse, domestic violence, human rights, and family court reform. Many of us have discussed this case before. Just as we have discussed many other cases like this one, where the courts have backed up the abuser and shut out or ignored the protective mother. And for your information, you'll find articles and links about those cases as well.
And all this policing of Claudine's personal and political activities on the internet is particularly hypocritical when you consider the following: Attorney JASON P. HOFFMAN and GAL JILL DYKES had no qualms about violating professional ethical boundaries and becoming facebook "friends" with this child! (I saw the screen shots.) Mom can't even post a photo of her daughter per court order, but these folks feel free to do as they like. Not that the judge was interested in this matter at all. Big surprise there.
And this is the crux of the matter. What the court in Shawnee County REALLY doesn't like is that--as they put it--this lady "has a cause." Or she has "become a cause." They don't like the "venom" (i.e. the truth) that has come out about this case, and the attention it has received nationally and even internationally. They don't even like Claudine's facial expressions! (Yes, the judge made a point of addressing this. "You are your own worst enemy!" he thundered at Claudine--apparently over some grimace or frown that I didn't see.)
So make sure you never show anything but a happy face in front of Judge Debenham, even when you are possibly losing all contact with your only child!
Claudine is supposed to hear later this afternoon what the court's decision is--after her daughter will presumably be allowed to speak her mind with the judge. But of course, she can't really speak her mind--not as long as she's a minor and dependent on her father.
We are not optimistic as to the outcome.
But you know what? In a little over two years, this girl ages out of the system's control over her life. Perhaps then, real change will come about.
Abusers and their enablers often win the battles. But they seldom win the war. That puts off any real healing in this case for another two years.
But at least it's something to hope for.

Daughter runs like the wind on her track team…this is the only way she’ll be able to see her own mother, Claudine Dombrowski. Daughter, they’ve crushed your mother and threw her into a whirlwind of hell and I don’t think you’d ever catch up to her, but they won’t stop until she is dead.
Claudine went in with her lawyer today to court with 67 incidents of contempt by HAL RICHARDSON, keeping Daughter from her mother. And what did the Dyke do…she whined and whined and got the judge to cut off all parenting time (AGAIN) and deny her any copies of transcripts or motions, seal the case, GAG her, and to top it off, took her cell phone away from her so she couldn’t talk to anyone.
Jill Dykes sent out her flying monkeys to destroy the mother-child bond. I don’t know how much HAL RICHARDSON is paying for this to continue his pleasure of abusing Claudine, but it may be possible he is passing drugs to the operatives in the case as he is allegedly dealing in the business. He has been in jail for it before I’ve heard. It must be something because a court just can’t keep breaking the law, and breaking a little girl’s heart.
He may have had an ass’s grin on his face today leaving court, but he’s one person you’ll see in hell I’m sure along with whinebag Jason P. Hoffman, daddy Don and the Dyke.
Things are far from over, we will pummel the governor’s office with this…and more.

“Peace, Be Still” That word from the Lord may be just what you need to hear right now. Isn’t it encouraging to realize that the storm you face may not necessarily originate from something you are doing wrong or some error in your life? You may be doing all the right things, trying your very best to follow the Lord. Sometimes that very pursuit will target you for some of the strongest hurricanes you will ever face. And for those storms that are the enemy’s attempts to dissuade you from following the Lord in obedience, the only proper response is rebuking them as our Lord Jesus did.
Jesus didn’t lay His hand on the sea; He just spoke to it. Here is the utterance of faith: divine authority. Actually, what He said was, “Be muzzled,” in the Greek. I don’t want to speculate about this, but it would appear to me that behind that storm, Jesus saw something satanic.
It’s very interesting that Jesus was on His way to what I would call His toughest case of deliverance—the Gadarene demoniac, whom He met on the other side. I cannot but believe that all Satan’s forces ganged up against Him to prevent Him getting to the scene of the deliverance of that man. I have seen—and probably you have, too—sometimes when we’re on a particular assignment, Satan will have his agents planted all the way along every situation and circumstance.
That’s a good sign God’s going to do something special, if you don’t get discouraged on the way.

I am almost beyond words at this news. However, all the people who believe in human rights, will learn about this blatant travesty of “justice”, and these kinds of abuses of the law will serve to change the systemic incompetence.What the laws and practices there and in many countries are telling mothers is : if your baby, child or YOU are beaten up, raped or otherwise abused- you have no recourse and no access to “justice”. The constitution is dead. Claudine Dombrowski victimized by RAPE committed by Hal Richardson, and battery on more than one occasion, with convictions. Words fail at the inhumanity committed in this case and so many others. The 1st Amendment to the US Constitution guarantees free speech, but if you are a woman in the US beware the courts will deny you your rights and take away your children.
It is so bad in the US that many women are just biding their time until their children are over 18 so they can leave their abusive husbands, and or the God Forsaken Hell Hole called the United States of America.

@ KT: YES, my mother’s sister stayed with her abusive husband until my two cousins graduated from high school, then she left with the clothes on her back, even though they were wealthy. Her husband had held her up to a wall with a gun to her head. He was a drunken abuser, but was a wealthy business owner, so got away with it, like my dad. My dad, who got custody of me and my siblings after beating my mother over and over, even in front of the neighbors. My aunt knew the same would happen to her, so she stayed. Fortunately she wasn’t killed like many women who stay.

I think it is VERY interesting that the Shawnee County District Court has done everything possible to prevent a bright light from being focused on this case. What ARE they hiding?
I think what they are hiding is that their GALs and court-appointed psychologists are incompetent as hell.
Ironically, Nancy, Gov. Mark Parkinson and First Lady Stacy Parkinson take particular pride in their efforts to prevent child abuse. This is lifted directly from his home page:

Okay. It’s enought. I think we have to stand united against this horrible injustice what happened to Claudine and Rikki. They don’t have right to strip the bond between them what was build when Claudine gave birth to Rikki. They do this for too much time and it’s enought. I’m so sorry Claudine and feel for you so much but I know that this is also not enought. We have to start writing letters, make phone calls to the above mentioned persons (governor and “first lady”) and if you want I’m willing to fly there (despite an order which denies my right to do this) and protest at the court’s and start a hunger strike because IT’S ENOUGH!!!!
We who love Claudine so much and know the pain she’s suffering years ago we have to organize a campaign for her. I’m sure that there MUST BE a thing which can help.

Rikki if you’re reading this your mother loves you with all her heart, she has fought to be your mother and has fought with every bit of energy she could muster. The court in johnston Cty Nc tried to gag me, after bringing in four contempts, and a motion to change place of child trade off for safety to a police station. I was denied and the lawyer went for a gag order. It was denied but I was told if I did not shut up I would get thirty days. I was violently abused by husband choking, ect for years in front of children. I now have my kids EOW and really do not know them at all. Now after a year off therapy for PTS, I was told this week I was sending emails to court whore, and it was my 14 year old daughter begging to see me, not myself.
I could not change venue to Wake Cty, which is not okay with domestic violence, but presiding judge said no, so I should have stayed with the ex, at least my children would see me, maybe bruised and battered but I could be there for them. I say to all, I am free now, with loads of time, maybe law school or what to try to stop this crap. It is wrong, very wrong.

Justice is more than blind. It’s no longer in our court rooms. If all of us did just a little we could do so much more. I will be talking about this on a radio show today. All of us need to pitch in and help this Mother and Child!!! May God help us find a way to let them be together again. Make noise, write, make phone calls. Please do what ever you can. We must find Justice and not stop until we do.
my children were awarded to their father who had a record of abuse in job and family services, chaining and beatings. although he forged my name on mortgages, removings tens of thousands in equity, plus liquidated 401k’s, he was awarded the home in chagrin falls. my children were ruined, screws drilled in my sidewalls were ignored by the cops, my kids were given bottles of liquor-a fax says:LOZA the GAL report and Nemeth Reply, that reply is the instruction from the court to give 15-16yr old boys liquor to throw the divorce, PI reviewed & so stated. support was withheld by the court and the GAL ontheir own motions. my record is gone, I watched, as the clerks of court blocked me physically while the magistrate tore out affidavits to the Court of Appeals. It is filth. these are the republican party, i think taking the unaccounted for $10,000.00& the home in lieu of the father keeping all other ohio police and fire assets. they tried to kill me, gave me four days to get out on Christmas Day-then when my son also id’s perjured testimony, he is given a bottle of jagermeister, in high school, rolls car, the cops look for his phone according to witnesses, not for my son, who walked away. Claudine and Rikki, I pray for you. There is no gag order to stop the hundreds of moms, and more gathering, who can, and will advocate for you and tell the truth about the systematic failures in family court that promote the abuse of women and children who have already been victimized.
Silence empowers the abusers and keeps these corrupt officials in office. Silence kept us women afraid and unable to get help. No more! We know what is being done to Claudine and Rikki, and we won’t stand by and let this happen..one gag order is not going to stop the protest and outrage of the gathering number of law abiding citizens whose tax dollars pay your salaries. We demand justice, and won’t stop until Rikki is safe with her mother, and these incompetent officers of the court are held accountable to the fullest extent of the law. We will write letters, we will petition, we will protest and raise such a public outcry that the court will be put to shame when the truth is made known.

The comment from PMA made me puke, I have seen PMA’s LIST of banned protective mothers and CLAUDINE’s name is on it….. Here’s some advice for all who are looking for guidance and acceptance in troubling times ~ It’s better to be alone than in bad company. There are many of us here who won’t stab you in the back -while pretending to be a friend, and who will help you heal your broken heart– and maybe, if we stick together and work hard, we’ll find justice together.

I do not know when justice will be delivered to you both and God knows it’s a long time over due! We are all committed to lifting you both up and they cannot gag us! Take your time to recover from this unjust, corrupt and broken miscarriage of justice. You have a great support system that will carry you through these times. God bless you both!
Sadly, Victoria’s comment holds much truth. What a SAD time it is when moms are being re-victimized by other moms and it’s organization such as PMA “International” (Protective Mothers Alliance) but alas Claudine, you are not alone, I too made it to this list along with other protective moms and advocates. Perhaps if Lundy was actively involved, this may not have happened.
