The lady (Claudine Dombrowski) in this picture was violently beaten by Hal Richardson, the father of her baby and ex-husband. Now Hal Richardson isn't exactly going to win any father awards this year for this, and his criminal record keeps growing (Battery, Attempted Battery, Battery of a Law Enforcement Officer, Obstruction of Legal Process, Possession of Marijuana and violation of Open Container law.)

Shawnee County Judge James P. Buchele refused to permit testimony in this case because his docket was full. If that wasn't bad enough, Claudine was ordered by this Judge to move back to Shawnee County so Hal Richardson could be closer to her daughter and ordered her not to call the police when dealing with her husband, all calls had to go through her case manager first. Allegations of death threats, rape and the killing of her daughter were what the Judge was not letting get into testimony. Okay, enough already, that last story is just wretched. First off, ask yourself this question, do judges make bad decisions? Of course they do, just like anyone who makes a choice does. To be fair, judges make all kinds of decisions everyday that can effect you and I detrimentally as the reason your seeing the Judge. The problem isn't the Judges, it really lies with the criminal justice system in itself. Is it a perfect system, of course not, not everyone is going to agree on the outcome. However, the Judges need to police each other. Now we know, there is a state agency for that, but seriously, how many District Judges have been removed in Kansas from the Bench? One, and it was so long ago Kansas records can't even remember what he was removed for. Now if a Judge does make a bad decision as clearly stated in the cases above, should he/she be able to correct that decision, or are they to high and mighty to correct their injustice after they have had some time to reflect? Some would say that's what the court of appeals are for, but why, come on, why does it have to even go to something like that?
Why do Judges entertain such nonsense? For instance, the spilt McDonald's coffee and the woman receives millions, or the burglar who falls through a skylight and sues the homeowner and wins a settlement. This is just absurd and Judges need to be held to account for letting these cases even be presented in their courtroom. It's simple, listen to each others arguments and inject some common sense and law into it. If it's an absolutely absurd complaint then dismiss it already....leave the story tellers to the librarians'. Common sense says if you rape a little girl or beat the hell out of your wife you shall get punished for that in a severe matter. However, the law states otherwise, and the list of outrage goes on. We believe at Patriotic Thunder that a Judge should have the ability to "depart" from the traditional sentencing, but dammit, use some common sense in ALL your cases and throw out the absurd ones, don't entertain this crap.

When I started this blog, over a year ago, I promised that I would expose every last criminal in family court.  I will continue to keep that promise and Mama Liberty will be expanding to other various outlets to give Mothers a voice even more.  We are United States Citizens with the same rights as any other.

The wind always blows mightily over Kansas as it has for so long,  just ask Dorothy.

Now the winds of change are upon the dirty family court system in Shawnee County.  Well over a decade a Mother in Kansas has fought the court system and its criminals to have visitation with her daughter.
Claudine Dombrowski continues to ask the court to follow the custody guidelines for her visitation time.  In February 2010 a miracle happened when the Judge actually adhered and allowed the now teenage daughter to have unsupervised visitation with her Mother with no interference from the father.

But the continued problems this Mother and Child face is the Guardian Ad Litem for the child, Jill M. Dykes, who wishes nothing more than to keep Claudine from her child.  Instead of trying to assistwith fostering a relationship with the Mother, Dykes wants to stay on this case, she wants more taxpayers money to keep her job.

Within the transcript of a hearing held in 2009 Ms. Dykes ineptness and bias against Claudine Dombrowski is evident. In the below transcript Dykes continues to interrupt the judge and fervently tries to prevent the judge from allowing unsupervised visitation. Dykes other favorite thing is to submit overtime to the county for keeping a parent and child separated.

Much to the dismay of the court system and specifically Jill M. Dykes this Mother is demanding that the statutes be upheld…otherwise they should terminate her parental rights.  It is not something that would be easy for any Mother but perhaps it is the right thing to do, in the best interest of the child and this mother.
They have once again started their campaign to end the unsupervised visits.  In fact what has been learned by this blogger is that :

“if there is any extended visitation time it would evaporate any progress that the mother and child have made.” 

That is right, you read that right, the court whores are going to make it very difficult for any mother and child relationship.  Therefore until justice is given to Claudine and her child, this blog and others will continue to expose the injustices by Shawnee County and those that profit from it. The winds of change are coming Shawnee…and its a BIG one…watch out for falling houses Jill

I came across this paper a couple years ago, stashed it, and just refound…it is an interesting concept….suing your abuser.  If the courts weren’t so bias against women, I’d say this should be seriously considered.  It is nice to wish though that the courts would be just and fair about anything.

The legal system’s response to domestic violence has improved somewhat in recent years. More abusers are arrested and more victims obtain orders of protection. Despite this progress, there is still a lot room for improvement. One legal remedy that surprisingly few victims avail themselves of is the civil tort suit. In the past, a legal doctrine known as interspousal immunity, combined with misguided perceptions of domestic violence as being a private matter, limited a woman’s ability to obtain compensation for abuse committed by a spouse. Perceptions about domestic violence are gradually changing and the interspousal immunity doctrine has been abolished in all but two states, providing today’s domestic violence victims with a range of potential tort causes of action. This article will discuss several of these causes of action and describe common defenses which must be overcome.
